The 9th U.S. Circuit Court of Appeals, in a 9-to-2 ruling Tuesday, upheld Oregon’s ban on in-person audio recording of others without informing those involved. The court found that the state law is content-neutral and contains a “relatively modest notice requirement” that is narrowly tailored to serve a significant government interest “in protecting conversational privacy.

The appellate panel ruled that Oregon has a significant interest in ensuring that its residents know when their conversations are being recorded.
